What is a personal data processing agreement?

A Data Processing Agreement (DPA) is a crucial legal instrument mandated by the General Data Protection Regulation (GDPR), a comprehensive data protection law enacted by the European Union (EU). DPAs are specifically designed to ensure compliance with GDPR requirements by establishing clear terms and obligations for data processing activities between data controllers (entities that determine the purposes and means of processing personal data) and data processors (entities that process personal data on behalf of the data controllers).

When a user of 3Shape's products and services enters into a Data Processing Agreement with 3Shape?

Concluding a DPA is only necessary if there is a relationship in which a 3Shape's customer (user of 3Shape's products and services) is a data controller and 3Shape is a data processor. 
As of today 3Shape acts as the data processor providing the following services:

• 3Shape Unite Cloud
• 3Shape Communicate
• 3Shape Cloud Storage 

When and in what form is the data processing agreement concluded?

The DPA is concluded before the user starts using the service. The DPA document will be presented for acceptance before using the service by checking a checkbox. It should be accepted by a person authorized to represent your company (3Shape Account on Company level). The concluded DPAs and their dates of conclusion can be found in the Company's 3Shape Account.

Where can I find the text of the DPA and who created it?

Below, you can find the DPA content for all 3Shape services. The main part of the DPA is identical across all services; the only differences are in the attachments specific to each service. The text of the main part of the DPA follows the standard clauses recommended by the Danish Data Protection Authority (Datatilsynet).
